OMG…I feel like such an idiot….What can I do?

Okay...yesterday I was passing through the mall because I had an appointment nearby. I was stopped by a guy at a stand from Seacret. He was kinda pushy and I'm obviously taken in easily. He buffed my nail and it looked nice. I told him I'd take the nail kit (turned out to be 49.99). He then said they give there customers a free treatment. So I went through the dead sea salt hand washing thing. I decided to buy the mud mask for the face which is supposed to do the same thing for the face instead of the body. That is b/c he told me it would make my acne go away and the scars. I believed every word he said. He also gave me a mud soap bar. I asked him could I get a refund if it didn't work. He said yes. Well, I wound up buying 200 dollars worth of products. He printed out two receipts, stapled them together, and thanked me. Well, I got home and did some research and it turns out they have been scamming ppl for awhile. I read one of the reviews and it said they stamped a no refund stamp on the back. I noticed the guy stamping something on it buy he mentioned something about my warranty for the nail buff. I didn't think to much of it. I just looked at my reciept and on the bottom of the 2nd one there's a little stamp that says no refunds. He lied to me. I feel sooo stupid. What can I do? Or is my money gone?

  1. Your money is gone. Promises made are not worth the paper they are not printed on. I expect you can file a complaint with a consumer agency. You could go back and demand a refund. You can also resolve to be a little more sceptical for every fast talk artist that you meet. When I get these people on the phone, unsolicited, I have a simple solution. No goodbye, no apologies, just "click".

  2. It’s not his fault you’re gullible.

  3. It’s long gone.

  4. you can report them to the better business bureau. or try to sell the stuff on ebay.

  5. I would call mall management & ask if they could help you or if you need to call the police or a lawyer. I think they will help you but if not you can try the other 2. If you told them you have a big mouth & would stand there or get eveyone you knew to take turns telling people they are crooked I think they would give you a refund & hope that you shut up. I would tell them that you could get the support of almost everyone at the mall cause no one wants to be taken advantage of.

  6. well im sorry to say you really cant do anything , Next time i would just be more careful and make sure you know whats going on but i do not think you can get your money back but you can at least warn other people about it.

  7. If you go up there and make a scene they WILL give you your money back. You just have to be firm, remind him of what he told you (that you could return the product) and that you will not leave and will stand there telling everyone who walks by what a rip off the products are. This happened to my best friend with the "head wizard". They demonstrated the vibrating, very nice product on her. Then for 49.99 she could purchase one. Well they switched the nice product for a non vibrating wooden handle one. After she tried to take it back and they pointed out the "no refund" stamp, I went back later and told them "this is crap, and we need a refund NOW." They were more than happy to comply.

  8. See if you can erase or cut of the lower portion of the receipt where the stamp is without damaging anything on the front of the receipt and also call your local fraud squad and report it . Even if you don’t get your money back they may be able to shut him down and you can also go there and protest near him so others don’t get ripped off.
You can also contact Mall management and report what you found out so they can take appropriate action.

  9. I was stopped in the mall the other day by two kiosks that were buffing nails. I just kept telling them that it was the wrong week to make a purchase but that I appreciated the nail and skin samples they used on me. They kept trying to lower the price, and pressure me to buy now. I just told them I had to think about it and would be back in a few hours if I changed my mind.

I then went online that night and discovered the nail buff.gloss sponge can be purchased online. The other stuff in the packet is just over priced lotions. The gloss blocks range from $3 to $5 a piece or you can buy them as a 4 pack.

Good luck. Definitely talk to the BBB and make a scene when you try to return the items.

  10. Aww. It’s ok

    *pats head*

  11. What a bummer, these people should be locked up.
If you can go back and demand your money back, take 2 friends with you and do not leave the stall until they refund you.
Also ring the Police, the Mall and anybody else you can think of.

Make sure one of your friends has a camera, I would pretend that she is a reporter from your local rag. Keep taking the pictures, this will upset them no end.

You will only delete the pictures when you have received your money.

Good luck, don’t give up to easy.

  12. Can you report them to the Mall? If they have a kiosk legitimately set up in the Mall, then I would report them to the Mall personnel.

Or, can you get a local news involved? You know how some reporters do stories on scams and such? Tell them your story and see if they could do some sort of an expose on it.

  13. I think your money is long gone, but I would recommend calling the mall and telling them this story.

I don’t know what policies they may have there, but where I’m from they would most certainly force the people to move along. Especially if there’s more than one complaint. It would be nice to do this to help other people not get scammed, as the mall is such a high traffic area (especially around this time of year).

If you’re really outgoing, I would say go back and make a scene. (Just go there and complain in person, let any customers they’re drawing in know about what happened. If you want, take a print out of the reviews to back it up, not that it’s considered solid evidence, but it will have more merit than just your word.)

  14. Ooooh, I had a friend who bought into the whole thing, and then was really pissed that she could’ve bought a normal mud mask and a buffing nail file for like 10 bucks with the exact same results.

It’s a scam, but it’s 100% legal for them not to accept returns or give refunds (unless it ruins your skin or something) especially on cosmetic products. Kind of the same as you can’t return makeup to most stores after you’ve used it.

Sorry dear, you have been had. Just chalk it up to experience, get the most out of your purchase and next time go to the Clinique counter instead :) Don’t feel too bad about it.

  15. Go back and try to get a refund. Try to talk to him and his direct manager. If you are unsuccessfull take it as a lesson learned. Don’t beat yourself up over it. Just know that some sales employees will say anything to get the sale. Then next time take a mental note of the products you are interested in and then go home and do some research before making the purchase. No matter what they say about final day of the sale, the sale will come around again or an even better one will come.

  16. I have to agree that you need to contact mall management and let them know what you found out about this company! Hopefully, they won’t like having known scammers associated with their mall, and will kick them out. You’re probably not going to get your money back, though.

I have an impulsive streak, sometimes when it comes to spending money, and what has worked for me is that I just don’t even acknowledge the people selling stuff out of those carts in the mall. I walk right past them and don’t even turn my head when they speak to me. Don’t worry about being rude, you need to do what you need to do to protect yourself. Once you get started doing it, it will get easier. The thing to remember is not to let them get started talking to you, then you’ll be okay. Sorry this had to happen to you, but if you learn from it, then it wasn’t wasted.

  17. you go back and talk to him before using any of it and ask for a refund, if that doesn’t work, talk to the mall management that he lied to your face about returns. You may be out of your money, but you can still fight back.
